The new year is often a time of new beginnings or, in this case, new rules. 2025 will see the implementation of new recycling rules across England, affecting all workplaces regardless of industry. The new set of laws, named ‘simpler recycling’ by the UK Government, means your business will have to adhere to a specific approach to waste management.

The new rules be implemented from 31 March 2025 (or 31 March 2027 for micro-firms).

What are the New Rules?

The simpler recycling rules chiefly concern the separation of waste. Workplaces will have a legal duty to separate the following types of waste.

  • Dry recyclable materials (plastic, metal, glass, paper and card).
  • Food waste.
  • Black bin waste.


If your business produces garden waste, the simpler recycling rules will mean your business has a legal responsibility to manage it according to the waste hierarchy and arrange for it to be either recycled or composted.

There are no rules about how big your bins or containers should be (you should be guided on this by how much waste your business produces). You also don’t have to provide bins to your customers but, if you choose to do so, you will need to provide a bin for each of the waste types above. 

Who do the Rules Affect?

Once they come in, the majority of workplaces (which the government website defines as businesses and non-domestic premises) in England will be affected. The rules say that any business that produces waste similar to household waste is included. Below is a list of some of the business types that this covers:

  • offices
  • retail and wholesale
  • transport and storage
  • hospitality
  • places of education
  • care homes

Please note, this list is not exhaustive and if you’re confused about whether your business is included you should check the official simpler recycling rules. It’s also important you remember that, while your waste collection provider also has a responsibility.

Duty of Care

Duty of care is a term used to refer to rules you, as a business owner, must follow when it comes to your waste. This is a law that requires you to store and handle any waste your business produces correctly.

You also have to do your due diligence on commercial waste companies. This is because you must only give your waste to registered handlers who are authorised to take it.
