Mobile Messaging Terms of Service

These Mobile Messaging Terms of Service ("Terms") govern your use of the Rich Communication Services (RCS) messaging and related SMS/MMS messaging services (collectively, the "Messaging Service") provided by Commercial Experts ("we," "us," or "our") to you.

By providing your mobile number and opting into our Messaging Service, you agree to these Terms and our main Privacy Policy and Terms of Use

1. Description of the Service

The Messaging Service is a business-to-business (B2B) lead generation and commercial communication service. We use RCS as a communication channel, with SMS/MMS used as an alternative. 

Purpose: Messages sent via the Messaging Service will relate to our commercial services, scheduling, service updates, and other relevant B2B communications based on your expressed interest in our offerings available at: Commercial Experts

2. Opt-In and Consent

You agree to receive commercial and marketing communications from us via mobile message when you:

  1. Explicitly provide your mobile number to us through a web form on: Commercial Experts

E-Signature for TCPA Compliance: By opting in, you agree that your action of submitting your mobile number and confirming your intent constitutes an electronic signature and consent to receive automated messages (such as autodialed marketing messages) from Commercial Experts at the mobile number provided.

3. Message Frequency and Cost

  • Frequency: The frequency of messages will vary depending on the progression of the lead generation process and the nature of your inquiry. You will receive messages as needed to service your request or follow up on your engagement with Commercial Experts.
  • Cost: Message and data rates may apply. Check with your mobile carrier for details on your specific plan. Commercial Experts do not charge a fee for the Messaging Service, but you are responsible for any charges imposed by your mobile carrier.

4. Opt-Out and Stopping Messages

You can withdraw your consent to receive mobile messages at any time.

To stop receiving all future messages, reply "STOP" to any message you receive from us.

5. Help and Support

For support regarding the Messaging Service, reply "HELP" to any message you receive from us.

6. Supported Carriers

The Messaging Service is available on all major U.S. mobile carriers. We are not liable for any delays in the receipt of any messages as delivery is subject to effective transmission from your mobile carrier.

7. Warranty and Liability

Commercial Experts will not be liable for any delays or failures in the receipt of any mobile messages as delivery is subject to the effective transmission of the message by your mobile carrier/network operator. We provide the service "as is."
